Employee Benefits/Executive Compensation
Since the success of any business is largely dependent upon favorable employer/employee relationships, all businesses need the resources of an employee benefits practitioner. The employee benefits practitioner strives to assist clients in formulating retirement, compensation, incentive, and fringe benefit plans for their employees, from executive and salaried employees to hourly and part-time employees.
Mr. Herman’s expertise in this area encompasses:
- Tax-qualified plans — including 401(k) plans, ESOPs, profit-sharing plans and stock bonus plans, target benefit plans, defined benefit plans, and age-weighted profit sharing plans; counseling on administration and qualified domestic relations orders (QDROs), loans, and hardship distributions
- Executive compensation arrangements — including employment agreements, non-qualified deferred compensation arrangements, Rabbi and secular trusts, incentive programs, excess benefit plans, and golden parachutes
- Many special benefit issues — including prohibited transaction issues, mergers and acquisitions, investment of plan assets, estate planning, and multiemployer plan issues
